If you’re involved in an accident in Texas, know that Texas is a fault-state. This means that whoever is at-fault in an accident, is liable for the damages.

But who actually determines who is at fault in an accident?

The Short Answer…

After getting into an accident, the police should be called. Once the police get on the scene, they will prepare a police report containing both driver’s interviews, and any other witness interviews who may have seen what happened.

The police report will then be submitted to their department and it MAY contain a statement about who was at fault.

If the police report does not contain a statement at who was at fault, then the responsibility of determining is up to the insurance agencies.

You must then file a claim with your insurance agency, where the investigation is handed to an ‘adjustor.” The Adjustor(s) will then research the accident and verify details and speak with the other’s driver’s insurance claims adjustor. Eventually, the adjustor will determine who was at fault and go from there.

Be sure to always take important photos and collect evidence in any car accident you are involved in. If the police cannot dertime who is at fault, your evidence may help your case through your claims adjustor.
