Being in an accident is not fun– and having to deal with all the paperwork that comes afterward is even less of a thrill.

Texas is an At-Fault State

Because Texas is an at-fault state, it means that in the case of an auto accident, the driver who is ‘at-fault’ is liable for the accident.

There are a few ways to determine who would be at fault in the event of an accident.

Police

If police are called to the scene, they will be required to file an accident report. An accident report will contain information such as names of both drivers, location of accident, insurance information, and any observations.

Insurance Agencies

If the at-fault driver denies responsibility, the insurance company can review the evidence to determine who is at fault. It is imperative to gather as much information as possible, such as pictures, contact information, and contact information of any witnesses.

Admission of Fault

Saying “sorry” to the other driver in the accident is the simplest way of admitting fault–even if it wasn’t your fault. Admitting anything at the scene of the accident could not work in your favor if the other driver reports your admission.

Call an Attorney

If you are having a hard time determining the fault of an accident, it might be best to call an attorney. Be sure to gather as much information as possible to help your case, including photos, witness information, and insurance and contact information of the other driver.

File a Claim

Once the fault has been determined, it is not time to file a claim. Assuming you are not at fault, and the other driver does have insurance, you will file a claim through the other driver’s insurance. Be sure to call your insurance company first to let them know of the accident.
